Via The Idaho Statesman:

The ACLU has filed an amicus curiae brief “on the behalf of U.S. Sen. Larry Craig.”

[Edit/Update] Teresa at the RedStateRebels.Net pointed the way to the actual brief. Careful! It’s in PDF form.

There’s no doubt Larry Craig has NEVER been an ally of any sort to the ACLU, but even your worst enemies may be your newest and bestest friends, eh – Larry?

Solicitation for private sex, the ACLU argues, is protected speech under the First Amendment no matter where it occurs. The ACLU filed the brief in the same Minnesota court where Craig is hoping to withdraw a guilty plea to disorderly conduct for soliciting sex from an undercover police officer in the men’s room of the Minneapolis airport.

In its brief, the ACLU argues that the government can arrest people for soliciting public sex only if it can show beyond doubt that the sex was to occur in public.

Guess ole’ Larr is going to stick with that entrapment, I’m not gay story then. Okey-doke! :D
